Introduction
This privacy notice aims to inform you about how we collect and process any information that we collect from you, or that you provide to us. It covers information that could identify you (“personal information”) and information that could not. In the context of the law and this notice, “process” means collect, store, transfer, use or otherwise act on information. It tells you about your privacy rights and how the law protects you.
We are committed to protecting your privacy and the confidentiality of your personal information.
Our policy complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The law requires us to tell you about your rights and our obligations to you in regard to the processing and control of your personal data. We do this now, by requesting that you read the information provided at http://www.knowyourprivacyrights.org
Except as set out below, we do not share, sell, or disclose to a third party, any information collected through our website.
-
Data Protection Officer
We have appointed a data protection officer (DPO) who is responsible for ensuring that our policy is followed. If you have any questions about this privacy notice, including any requests to exercise your legal rights, please contact our DPO, Nigel Allman, at nigel.allman@axentia.co.uk.
- Data we process
We may collect, use, store and transfer different kinds of personal data about you. We have collated these into groups as follows:
- Your identity – first name, last name, job title, and other identifiers you may provide.
- Your contact information – business address, email address, telephone number and any other information you give us for the purpose of communication or meeting.
- Technical data – your internet protocol (IP) address, browser type and version, time zone setting and location, operating system and platform, and other technology on the devices you use to access this website.
- Usage data – information about how you use our website, products and services, including pages visited and enquiries made.
- Marketing and communications data – your preferences in receiving marketing from us, and your communication preferences.
We do not take payment through our website, so we do not collect or process your financial or payment card details ourselves.
We may aggregate anonymous data such as statistical or demographic data for any purpose. Aggregated data may be derived from your personal data but is not considered personal information in law because it does not reveal your identity. However, if we combine aggregated data with your personal information so that it can identify you, we treat the combined data as personal information under this notice.
- Special category personal information
Special category data is data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, and health, genetic or biometric data.
We do not collect any special category data about you through this website.
- If you do not provide personal information we need
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform that contract or provide a service to you. If so, we will notify you of this at the time.
The bases on which we process information about you
The law requires us to determine under which of six defined bases we process different categories of your personal information, and to notify you of the basis for each category. If a basis on which we process your personal information is no longer relevant, we shall stop processing your data on that basis.
- Information we process because we have a contractual obligation with you
Where you engage us for services, or otherwise agree to our terms and conditions, a contract is formed between you and us. To carry out our obligations under that contract we must process the information you give us.
- Information we process with your consent
When you browse our website, book a meeting with us, or ask us for more information about our services, you provide your consent for us to process information that may be personal information – for example, by agreeing to our use of non-essential cookies, or by submitting an enquiry form.
You may withdraw your consent at any time by contacting our DPO, Nigel Allman, at nigel.allman@axentia.co.uk. However, if you do so, you may not be able to use certain features of our website or services further.
- Information we process for the purposes of legitimate interests
We may process information on the basis there is a legitimate interest, to you or to us, in doing so. Where we rely on this basis, we consider whether the same objective could be achieved through other means, whether processing might cause you harm, and whether you would reasonably expect us to process your data. Examples include:
- record-keeping for the proper administration of our business
- responding to enquiries and communications you send us
- understanding how visitors use our website, so we can improve it
- protecting and asserting our legal rights
- Information we process because we have a legal obligation
Sometimes we must process your information to comply with a statutory obligation. For example, providing information to legal authorities where they have proper authorisation to request it.
This may include your personal information.
Specific uses of information you provide to us
- Complaints regarding content on our website
If you complain about any content on our website, we shall investigate your complaint and, if we believe it is justified or the law requires it, remove the content while we investigate.
- Payment
We do not process payments through our website. If, in the course of our business relationship with you, we require payment details, these will be collected separately and are outside the scope of this website privacy notice.
- Job applications and employment
If you send us information in connection with a job application, we may keep it for up to one year in case we wish to contact you at a later date. If we employ you, we collect information about you and your work throughout your employment, used only for purposes relevant to that employment. After employment ends, we keep your file for six years before destroying or deleting it.
- Communicating with us
When you contact us, whether by telephone, through our website, or by email, we collect the data you give us in order to reply. We keep personally identifiable information associated with your message, such as your name and email address, so we can track our communications with you and provide a good quality service.
- Complaints
When we receive a complaint, we record the information you have given us and use it to resolve your complaint. If resolving your complaint reasonably requires us to contact another person, we may share some of the information contained in your complaint with them; we do this as infrequently as possible.
Use of information we collect through automated systems when you visit our website
- Cookies
Cookies are small text files placed on your device by your web browser when you visit a website. They allow information gathered on one page to be stored until needed on another, so a website can provide a personalised experience and give the website owner statistics about how the website is used.
Some cookies last only for your browsing session; others last longer. Your web browser allows you to view, delete, block or limit cookies.
Our website uses cookies placed by us and by the third-party services described below. When you first visit our website, we ask whether you consent to non-essential cookies. If you do not consent, we will not set non-essential cookies for your visit.
You can also control cookies through your browser settings. Please be aware that disabling certain cookies may affect the functionality of our website. Guidance on managing cookies in common browsers:
- Google Chrome: https://support.google.com/chrome/answer/9564
- Mozilla Firefox: https://support.mozilla.org/en-US/kb/cookies-information-websites-store-on-your-computer
- Safari: https://support.apple.com/en-gb/guide/safari/sfri11471/mac
- Microsoft Edge: https://support.microsoft.com/en-us/microsoft-edge/delete-cookies-in-microsoft-edge
To opt out of Google Analytics tracking across all websites, you can install the Google Analytics Opt-out Browser Add-on: https://tools.google.com/dlpage/gaoptout
- Website analytics: Google Analytics and Google Search Console
We use Google Analytics to understand how visitors use our website – for example, which pages are viewed, how long visitors stay, and how they arrived at the site. Google Analytics sets cookies on your device that collect technical and usage data, including your IP address (which we do not use to identify you individually) and browsing activity on our site.
Google Analytics cookies are only placed on your device if you have consented to analytics cookies via our cookie consent banner.
For more information about how Google uses data collected through Analytics, please visit https://policies.google.com/technologies/partner-sites
We also use Google Search Console, which provides us with aggregate information about how our website appears in Google Search results (such as search queries and click-through rates). Search Console does not set cookies on your device; it primarily reflects data about the website’s search performance rather than data about you as an individual visitor.
Both services are provided by Google Ireland Limited / Google LLC. Further information is available in Google’s own privacy policy.
- Tag management: Google Tag Manager
We use Google Tag Manager (GTM) to manage the tags and tracking codes on our website, including those for Google Analytics. GTM is a delivery mechanism: it does not itself collect personal data or set cookies, but it is used to load the other tools described in this notice, subject to your cookie consent choices.
- Forms and meeting bookings: HubSpot
Enquiry forms on our website, and our meeting-booking tool, link directly to HubSpot. When you complete a form or book a meeting, the information you provide (such as your name, email address, company and any message or booking details) is sent directly to and stored in our HubSpot account, rather than being collected by us separately.
HubSpot also sets its own cookies to recognise repeat visitors and to help us understand engagement with our website and follow up on enquiries. We use this information to respond to your enquiry, arrange meetings, and, where you have consented, to send you relevant marketing communications.
HubSpot, Inc. is based in the United States and acts as a processor on our behalf for this data. Further information is available in HubSpot’s own privacy policy.
- Personal identifiers from your browsing activity
Requests by your web browser to our servers for web pages and other content are recorded. We record information such as your general geographical location, your internet service provider and your IP address, together with information about the device and browser you use. We use this information in aggregate, via the tools described above, to assess how our website is used and performing.
- Remarketing and advertising
We do not currently use remarketing or third-party advertising cookies on this website. If this changes, we will update this notice and our cookie consent tool accordingly.
Disclosure and sharing of your information
- Information we obtain from third parties
Although we do not disclose your personal information to third parties except as set out in this notice, we may receive data indirectly derived from your personal information from the third-party services we use, such as Google and HubSpot.
- International data transfers
Our website is hosted in the United Kingdom. However, the third-party services we use – Google Analytics, Google Search Console, Google Tag Manager and HubSpot – are provided by organisations based in, or that process data in, the United States.
Where your personal data is transferred outside the UK, we require that appropriate safeguards are in place. These include the organisations’ certification under the UK Extension to the EU-U.S. Data Privacy Framework, and/or their use of the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses. We recommend checking each provider’s own privacy and data transfer documentation for the specific mechanism currently in place, as these arrangements are periodically reviewed by regulators and can change.
Control over your own information
- Your duty to inform us of changes
It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes.
- Access to your personal information
You may ask us for a copy of the information we hold about you at any time by contacting our DPO. After receiving your request, we will tell you when we expect to provide the information, and whether any fee applies.
- Removal of your information
If you wish us to remove your personal information, you should contact our DPO to make your request. This may limit the service we can provide to you.
- Verification of your information
When we receive a request to access, edit or delete personal information, we will first take reasonable steps to verify your identity before taking any action. This is to safeguard your information.
Other matters
- Use of the site by children
Our website and services are aimed at businesses and are not directed at, or marketed to, children. We do not knowingly collect personal data from children. If you believe a child has provided us with personal information, please contact our DPO so we can remove it.
- Encryption of data sent between us
We use Secure Sockets Layer (SSL/TLS) certificates to verify our identity to your browser and to encrypt data you send us. You can check this by looking for a closed padlock symbol in your browser’s address bar.
- How you can complain
If you are unhappy with this privacy policy, or with how we process your personal information, please contact our DPO in the first instance.
You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO):
Website: https://ico.org.uk/make-a-complaint/
Telephone: 0303 123 1113
Post: Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF
We would, however, appreciate the opportunity to address your concern before you approach the ICO.
- Retention period for personal data
Except as otherwise stated in this notice, we keep your personal information only for as long as necessary:
- to provide the services you have requested;
- to comply with other law, including the period required by tax authorities;
- to support a claim or defence in court.
Data collected via Google Analytics is retained according to the retention period configured in our Google Analytics account. Data held in HubSpot is retained in line with our data retention practices for that platform. Please contact our DPO if you would like details of the current retention settings.
- Compliance with the law
This privacy notice has been compiled to comply with UK data protection law. If you think it fails to satisfy the law of your jurisdiction, we should like to hear from you. Ultimately, it remains your choice whether you wish to use our website.
- Review of this privacy policy
We may update this privacy notice from time to time as necessary. The terms that apply to you are those posted here on our website on the day you use it. If you have any question regarding our privacy policy, please contact our DPO.
